1. Introduction
Welcome to CollectiveAccessAtlas ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at collectiveaccessatlas.sbs (the "Service") operated by CollectiveAccessAtlas.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you do not agree with any part of these terms, then you should not access the Service.
2. Service Overview
CollectiveAccessAtlas offers top-tier yacht charter services, including but not limited to:
- Day-long yacht hires
- Evening boat tours
- Business team outings
- Private celebrations
- Extended voyages
All offerings are contingent upon availability and the prevailing weather conditions. We maintain the right to alter or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To reserve a charter, you must:
- Be a minimum of 18 years old
- Supply truthful and complete information
- Pay the requisite deposit as indicated in your booking confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
We will only confirm your booking once payment has been made and we have issued a written confirmation. We reserve the right to deny service to any individual based on our discretion.
3.3 Availability
All charters depend on the ready availability of the vessel and favorable weather conditions. We will strive to accommodate your preferred booking dates and times.
4. Payment Terms
4.1 Pricing
All prices are expressed in € and inclusive of any applicable taxes unless otherwise specified. Prices are subject to amendments without prior notification.
4.2 Payment Schedule
- Deposit: 50% of the total charter cost is due upon booking
- Final payment: Payable 48 hours before the charter departs
- Incidental expenses (where applicable): Payable at the charter's conclusion
4.3 Payment Methods
Accepted forms of payment include major credit cards, electronic bank transfers, and verified cheques. Our payment processing is carried out using secure, encrypted platforms.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours before departure: Complete refund minus transaction fees
- Between 24 and 72 hours prior to departure: 50% refund
- Within 24 hours of departure: No refund possible
5.2 Weather-Related Cancellations
If unsafe weather conditions are assessed by our captain, we will propose to either:
- Schedule the charter for another available date with no extra charge
- Issue a full refund if rebooking is unfeasible
5.3 Mechanical Failures
In case of mechanical issues with the designated vessel, we will endeavor to offer an equivalent alternative. Should no replacement vessel be available, we will provide a complete refund.
6. Safety and Conduct
6.1 Safety Regulations
All passengers are expected to:
- Heed all directions from the crew
- Utilize safety gear as required
- Disclose any health conditions that might affect their security
- Stay within the confines of allocated areas on the vessel
6.2 Prohibited Articles
The items listed below are forbidden onboard:
- Containers made of glass
- Illegal materials
- Weapons or arms
- Immoderate non-alcoholic beverages (beyond reasonable consumption)
- Pets (save for situations with prior approval)
6.3 Behavior
Guests must act courteously and respectfully. We hold the right to end a charter ahead of schedule without a refund if a passenger's actions pose a risk to safety or disrupt the experience for others.
7. Liability and Insurance
7.1 Limitation of Our Liability
Our responsibility is confined to the charter fee paid. We shall not be accountable for:
- Injuries sustained due to passenger imprudence
- The loss or damage of personal items
- Indirect, resulting, or punitory damages
- Delays caused by the weather or issues outside our control
7.2 Insurance Policy
Our vessels and operations are covered by comprehensive marine insurance. It is incumbent on passengers to secure their own travel and personal insurance.
7.3 Acknowledgment of Risk
By participating in our charter services, you realize the inherent perils associated with marine activities and accept responsibility for your own safety and security.
8. Alterations and Itinerary Adjustments
We have the authority to adjust itineraries, routes, or timetables based on climatic conditions, safety concerns, or operational demands. We will make every effort to ensure a comparable substitution of experiences.
9. Force Majeure
We are not accountable for interruptions, cancellations, or changes instigated by factors outside of our control, such as but not limited to:
- Severe meteorological manifestations
- Catastrophic events
- Mandates from the government
- Port operations being suspended
- Failures of equipment
10. Privacy and Information Protection
We manage your private data in agreement with our Privacy Policy. By employing our services, you concur to our data collection and utilization as detailed in our Privacy Policy.
11. Intellectual Property Rights
Our website's content, including text, imagery, logos, and graphics, is safeguarded by copyright and trademark statutes. Unauthorized reproduction, distribution, or derivative creation is prohibited without our express permission.
12. Applicable Legislation
The laws in force in France dictate these Terms. Any disputes will be settled in the courts of Nice, France.
13. Amendments to Terms
We retain the right to alter these Terms at will. Revisions will be communicated on our website with a notice of the update's date. Continuous engagement with our services denotes assent to the revised terms.
